This agreement contains the terms and conditions that apply to your purchase from www.andyshealthwellness.com and Andy's Health & Wellness ("Andy's Health & Wellness") that will be provided to you ("Customer") on orders for products sold in the United States. By accepting delivery of the products described on the invoice, Customer agrees to be bound by and accepts these terms and conditions. 1. Other Documents. These terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement, or amend this document or to enter an order for product(s) which is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and Andy's Health & Wellness.

2. Governing Law. THIS AGREEMENT AND ANY SALES THEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TENNESSEE, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.

3. Payment Terms; Orders; Quotes; Interest. Terms of payment are within Andy's Health & Wellness sole discretion, and unless otherwise agreed to by Andy's Health & Wellness, payment must be received by Andy's Health & Wellness prior to acceptance of an order. Payment for products may be made by credit card, wire transfer, debit card, cash, or another approved payment method. Invoices are due and payable within the time period noted on the invoice. Andy's Health & Wellness may invoice parts of an order separately. Orders are not binding until accepted by Andy's Health & Wellness. Any quotations provided by Andy's Health & Wellness are valid only for the period stated in the quotation. Customer agrees to pay interest on all past-due balances at the highest rate permitted by law. Andy's Health & Wellness reserves the right to limit quantities or refuse service to any customer at its sole discretion.

4. Shipping Charges; Taxes. Separate charges for shipping and handling will be shown on Andy's Health & Wellness invoices. Unless Customer provides a valid tax exemption certificate prior to order acceptance, Customer is responsible for all applicable sales taxes and other taxes associated with the order.

5. Title; Risk of Loss. Title to products passes from Andy's Health & Wellness to Customer upon shipment from its facility. Loss or damage occurring during shipment by a carrier selected by Andy's Health & Wellness is the responsibility of Andy's Health & Wellness. Loss or damage occurring during shipment by a carrier selected by the Customer is the responsibility of the Customer.

6. Warranties; Disclaimers. ANDY'S HEALTH & WELLNESS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In addition to these terms and conditions, Customer agrees to be bound by all applicable terms contained elsewhere on this website.

7. Return Policy. Products purchased directly from Andy's Health & Wellness may be returned according to the return policy in effect at the time of purchase as published on www.andyshealthwellness.com.

8. Products. Andy's Health & Wellness reserves the right to revise, discontinue, update, or modify products at any time. Prices, promotions, and availability are subject to change without notice.

9. Price Definitions and Promotions. "Retail Price" refers to the manufacturer's suggested retail price. "Andy's Health & Wellness Price" refers to the standard non-promotional price listed on www.andyshealthwellness.com. Promotional offers are available for limited periods and while supplies last.

10. Limitation of Liability. ANDY'S HEALTH & WELLNESS SHALL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS, CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING FROM THE PURCHASE OR USE OF ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Applicable Law; Not for Resale. Customer agrees to comply with all applicable federal, state, and local laws. Products are sold for personal use and not for resale unless otherwise authorized in writing by Andy's Health & Wellness.

12. Headings. Section headings are provided solely for convenience and shall not affect the interpretation of these Terms and Conditions.

13. Acceptance. By ordering any product from Andy's Health & Wellness, whether through www.andyshealthwellness.com, telephone, email, in person, or any other method, Customer agrees to be bound by these Terms and Conditions of Sale.
